FEC Commissioner Says Ocasio-Cortez Faces Jail Time for PAC/Campaign Collusion

Former FEC commissioner Hans von Spakovsky says that Congresswoman Ocasio-Cortez and her Chief of Staff may have engaged in multiple violations of federal campaign finance law and could face jail time.

“If the facts as alleged are true, and a candidate had control over a PAC that was working to get that candidate elected, then that candidate is potentially in very big trouble and may have engaged in multiple violations of federal campaign finance law, including receiving excessive contributions,”  Spakovsky told The Daily Caller News Foundation.

They apparently violated campaign finance law by laundering almost $1 million in contributions from PACs that Chakrabarti established to private companies that he also controlled. as revealed in an explosive complaint filed Monday with the Federal Election Commission. The money seemed to just flow back and forth.

Election attorney Charlie Spies explained the situation to the TheDCNF:

“It looks like the campaign and PAC are under common control and the PAC was funding campaign staff and activities as an alter-ego of the campaign committee, which would be a blatant abuse of the PAC rules.”

“At minimum, there’s a lot of smoke there, and if there are really only three board members and she and [Chakrabarti] are two of them, sure looks like you can see the blaze,” Smith, a Republican, told TheDCNF. “I don’t really see any way out of it.”

If the FEC is able to determine that Ocasio-Cortez and Chakrabarti knowingly and purposefully hid their ties between the campaign and the PAC from the FEC to bypass campaign contribution limits, they could both face prison time.

Everyone knows that there is supposed to be a SERIOUS wall between a PAC and a campaign and candidate. Not an inch of collusion is allowed.

The Justice Democrats PAC was controlled by Ocasio-Cortez, Chakrabarti, and another who held “legal control” of the PAC. They both still serve on the three-member board of Justice Democrats on paper.

The Daily Caller states:

And if the FEC concludes that Ocasio-Cortez’s campaign and Justice Democrats were operating as affiliated committees, “then anyone who contributed over $2,700 total to her campaign and the PAC would have made an excessive contribution,” which is a campaign finance violation, Smith told TheDCNF.

Ocasio-Cortez’s campaign and Justice Democrats raised a combined $4.6 million during the 2018 midterm election cycle, FEC records show. There’s a maximum five-year prison sentence for anyone who knowingly and willfully receives a collective $25,000 or more in excessive campaign contributions in a single calendar year.

Large financial transfers from PACs to LLCs are not necessarily improper. But he complaint argues that the goal of the “extensive” scheme was to illegally dodge detailed legal reporting requirements of the Federal Election Campaign Act of 1971, which are designed to track campaign expenditures.

“It appears ‘strategic consulting’ was a mischaracterization of a wide range of activities that should have been reported individually,” the complaint states.

Ocasio-Cortez, and the leftist mantra has been about evil dark money. It looks like, at the least, she is up to her neck in dark money, and as well is in full denial!
