On Monday, the Supreme Court handed President Trump a “clear victory for our national security”. The Supreme Court lifted the injunction blocking the ban as of Monday morning, June 25. The Court also ruled that key parts of Trump’s executive order banning travel and immigration can take effect while the Court considers the case.
Trump’s ban prohibits people from six Muslim majority countries (Iran, Libya, Somalia, Sudan, Syria, and Yemen) from entering the United States for 90 days. The ban also suspends the refugee program for 120 days.
In addition, the Supreme Court will hear the full case in October. In the meantime, the SCOTUS knocked down the lower courts’ move to completely shelve the ban. Instead, the SCOTUS ruled that some foreign nationals from the six states included in the second executive order could be kept from entering the U.S.

The Supreme Court lifted most of the injunction blocking the president’s travel ban, allowing it to be implemented in most instances. Exceptions to the ban would cover individuals with a “bona fide relationship” with an American citizen.
Trump’s executive order would ban immigration for 90 days from Iran, Libya, Somalia, Sudan, Syria and Yemen.
The Court agreed Monday to hear arguments on the case in its fall term, which begins in October.
Trump’s order limits travel from six countries for 90 days and suspends the refugee program for 120 days, which means that the order will have almost expired before the Court gathers to decide if Trump acted within his powers to promulgate it.
The president’s temporary travel ban was blocked in May by the 4th Circuit Court of Appeals, affirming a federal judge’s decision from March.
The 4th Circuit ruled the order contained “vague words of national security,” but its context “drips with religious intolerance, animus and discrimination.”
The appeals court based its ruling in large part on Trump’s campaign rhetoric as a candidate.
“Then-candidate Trump’s campaign statements reveal that on numerous occasions, he expressed anti-Muslim sentiment, and well as his intent, if elected, to ban Muslims from the United States,” the court said.
Acting Solicitor General Jeffery Wall said the 4th Circuit “failed to adhere to foundational legal rules” in its ruling to halt the temporary travel ban.
“The Constitution and acts of Congress confer on the president broad authority to suspend or restrict the entry of aliens outside the United States when he deems it in the nation’s interest,” Wall said.
Here’s the ruling from the Supreme Court:
“We grant the Government’s applications to stay the injunctions, to the extent the injunctions prevent enforcement of §2(c) with respect to foreign nationals who lack any bona fide relationship with a person or entity in the United States,” the ruling stated.
The Supreme Court wanted to make it very clear that anyone from one of the six countries who have no ties to the U.S. will be denied entry.
“[T]he injunctions reach much further than that: They also bar enforcement of §2(c) against foreign nationals abroad who have no connection to the United States at all,” it continued.
“As president, I cannot allow people into our country who want to do us harm,” the president proudly stated. “I want people who can love the United States and all of its citizens, and who will be hardworking and productive.”
“Today’s ruling allows me to use an important tool to protect our Nation’s homeland. I also am particularly gratified that the Supreme Court’s decision was 9-0,” he said.
The ban is necessary to protect our nation while the administration decides whether tougher vetting procedures and other measures are needed. Of course, there is no doubt, based on Obama’s “loosey goosey” policies of immigration that we need strong vetting procedures.
During the Obama administration there were 16 terrorist attacks on American soil. These attacks must end. Thanks to the ruling of the SCOTUS, and the appointment of Justice Gorsuch, President Trump’s executive order will be implemented.
