Barack Obama is moving ahead on his executive amnesty program, just in a slightly different way. A federal court has blocked his amnesty for illegals scheme to blend up to 15 million illegal aliens into society in a quasi-legal maneuver.
But one thing we know about the President is that he doesn’t let little things like the Constitution or the law inhibit him.
His current amnesty program is for businesses that hire illegals. They’re getting a free pass .
Through the first five months of this fiscal year, U.S. Immigration and Customs Enforcement conducted just 181 workplace audits and brought charges against only 27 employers, putting it on pace for fewer than 500 audits and just 65 arrests this year. That’s less than 15 percent of the total audits conducted in 2013.
“Employers now face very little risk in hiring illegal workers and have little incentive to abide by the law,” wrote the report author, Jessica Vaughan, policy studies director at the center.
This action by ICE flies in the face of Obama’s promise to “go after” employers who hire illegal aliens. It’s kind of like, “If you like your illegal alien worker, you can keep your illegal alien worker.” Never mind that 100% of all new jobs in the last 15 years have gone to aliens. Employment of native born US citizens is actually down by 127,000 while employment of aliens is up 5.7 million. That includes illegal aliens and the H1B employees that Disney hired to replace their IT staff.
Americans want employers investigated and they want them to use E-Verify in their hiring process. President Obama doesn’t give a tinkers dam about that. He wants to grease the wheels for 15 million new Democrat voters.
Some states have state law that requires employers to use E-Verify, our home state of Arizona for one, but penalties are so light and so infrequently assessed that it’s a requirement in name only.
The US could eliminate illegal immigration in a heartbeat if we wanted to with just a few simple steps.
Make it a felony to employ or rent to an illegal alien. It’s currently a misdemeanor and police agencies don’t much care about enforcing the law for a misdemeanor.
An E-Verify form for the employee or renter on-file is an affirmative defense if the person turns out to be an illegal and beat the system.
The felony charge cannot be reduced to a misdemeanor.
Large mandatory fines – $10,000 per illegal – that are not dischargable in bankruptcy and are levied against the business owner or highest ranking local officer of a public company.
Mandatory, short, jail terms – not prison – for offenders. One month per illegal.
These five simple steps will incent law enforcement to enforce the law. It will provide real incentive to employers and property managers to use E-Verify and not hire or rent to illegals. The businesses most apt to hire an illegal alien are construction and hospitality and if you have a felony conviction you typically can’t get a contractors’ license or a liquor license. In terms of property managers, typically a felony will cost you your real estate license.
Bingo, these disincentives would put halt to work and a roof over the illegal’s head. Better to stay in Mexico. And, if the illegal happens to come from Central or South America, well, let them stay in Mexico. The Mexicans have an immigrant friendly immigration policy.
